  • Electronic signatures, or digitally signed?

    Electronic signatures is the gig/png etc ot the signature

    Digitally signed involved a secured hash of the document.

    Depending on the document you may need a 'wet' signature for certain things such as house purchases, leasehold contracts, death/birth certiticates etc. But normal documents to present with a PO then an electronic signature is fine.

  • I used to work for a courier firm a few years ago and we started to use electronic signatures so we could bill the same day rather than wait for the proof of delivery the next day when the drivers return.

    We used to ask the person to enter their surname and sign the box. It automatically captured the lat lon details of where it was signed for and transmitted the file back to us as an xml file within 2 minutes of being signed for.

    We would run the lat lon details through our system and if it came back with the same postcode as the delivery then the invoice was automatically raised and emailed out. IF the details weren't the same some manual checks would be carried out against the viechle tracker to confirm location.

    We never got as far as courts, but several clients refused to pay saying the goods hadn't been delivered. As soon as we introduced this system they never queried anything again

  • In theory, yes. Although I suppose there's always the possibility that someone has access to that email or hypothetically if it's a shared email.

    I guess that's a security issue that would need to be addressed by the company/organization.

  • Short answer is yes, an electronic signature is just as legally binding as a physical signature, and since there is a digital footprint of the signature taking place, is actually easier to prove as a legit signature in some cases. Still, I'm sure there are cases where a loophole has been found.

  • Depends also on the country. For the EU there are well defined rules as eIDAS.

  • It's almost impossible to answer legal questions without knowing the specific jurisdiction. 

    Generally, an electronic signature is as legally binding as a paper and ink signature, however if you believe this is likely to go to court, I would advise you to consult with a local lawyer who is familiar with the laws in your area.

  • According to my attorney, some judges frown upon electronic signatures but in most cases they are legal.
